Mochroom – Terms of Use

1. Acceptance of Terms

By downloading, accessing, or using the Mochroom mobile app ("App"), you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the app. Continued use after updates to these Terms constitutes your acceptance of the revised version.

2. Eligibility

You must be at least 18 years old to use Mochroom. By using the app, you confirm that you meet this age requirement and that all information you provide is true and accurate. Mochroom does not knowingly collect or allow use by anyone under 18.

Mochroom is a community-driven social platform for discovering, sharing, and discussing movies. The app includes features such as watchlists, reviews, polls, social groups, and the WatchParty feature. The website (mochroom.com) provides information about the app and download links only — all user interactions occur within the mobile app.

4. Your Account

You must create an account to use most Mochroom features. You are responsible for:

• Keeping your login credentials confidential
• Maintaining control over your devices and sessions
• All activity that occurs under your account

Mochroom reserves the right to suspend or delete accounts that violate our policies, involve illegal activities, or abuse the platform — with or without prior notice.

• Not upload, post, or share anything illegal, harmful, defamatory, or infringing

WatchParty Disclaimer

The WatchParty feature allows users to organize social gatherings to watch movies together. Mochroom only provides the digital tools to coordinate such events — we do not organize, sponsor, verify, or oversee any WatchParty or its attendees.

By participating, users agree that:

• Attendance and participation are entirely voluntary and at their own risk
• Mochroom is not responsible for any injury, loss, harm, or dispute that may occur
• Users are responsible for ensuring their own safety, legal compliance, and accurate event details
• Mochroom does not verify or endorse any user, event, or venue

We strongly encourage users to exercise caution and good judgment when organizing or attending WatchParties.

6. Content Ownership & Usage

User-Generated Content

You own the original content you create and post (reviews, lists, polls, comments, etc.). However, by posting on Mochroom, you grant Mochroom a non-exclusive, royalty-free, worldwide license to display, share, and distribute your content within the app.

Third-Party Media

Movie posters, titles, and metadata come from trusted external sources such as TMDB (The Movie Database) and OMDB (Open Movie Database). Such materials remain the property of their respective rights holders and are used under appropriate API terms. You acknowledge that your posts containing this external media do not grant ownership of the underlying movie materials.

7. Privacy & Data Protection

Your privacy matters to us. Mochroom collects and processes data as described in our Privacy Policy, which is part of these Terms. We use encryption, secure authentication, and strict access controls to protect your data. You can manage your privacy settings, analytics consent, and marketing preferences within the app.

8. Advertising & Promotions

Mochroom may display non-personalized advertisements or movie promotions based on:

• Your language and genre preferences set in the app

Mochroom is provided "as is" and "as available." We make no guarantees about uninterrupted service, accuracy, or specific outcomes. To the fullest extent permitted by law, Mochroom and Zidyn Solutions are not liable for:

• Any direct, indirect, or consequential losses or damages
• Any user conduct, content, or offline interactions (including WatchParties)
• Data loss, unauthorized access, or service interruptions

You use the app at your own risk.

10. Dispute Resolution & Governing Law

These Terms are governed by the laws of Ontario, Canada.

If a dispute arises, both parties agree to:

• First attempt to resolve the issue informally through good-faith communication.
• If unresolved, proceed to binding arbitration under the Arbitration Act, 1991 (Ontario) in Toronto, Canada.
• If arbitration is unenforceable, disputes may be settled in the courts of Toronto, Ontario.

11. Updates to the Terms

Mochroom may update these Terms at any time without prior notice. When significant changes occur, users will be prompted to re-accept the Terms via:

• An in-app pop-up, or
• An email notification before continued use of the app

Continued use after notice means you agree to the updated Terms.

Mochroom is currently a free-to-use app. We may introduce premium features in the future, but users will always be clearly informed before any charges apply.
